Welcome to SmartQuip® ("we," "our," or "us"), an equipment rental marketplace operated by Kavod Technologies (Pty) Ltd. These Terms of Service ("Terms") govern your access to and use of our platform, including our website, mobile applications, and related services (collectively, the "Service").
1Acceptance of Terms
By creating an account, accessing, or using SmartQuip, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not access or use our Service. We reserve the right to modify these Terms at any time, and will provide notice of material changes via email or platform notifications.
2Description of Service
SmartQuip is a technology platform that connects equipment owners ("Owners") with individuals and businesses who need to rent equipment ("Renters") for various projects.
Our platform provides:
- Equipment listing and discovery
- Secure booking and payment processing
- Insurance coverage for all rentals
- Delivery and logistics coordination
- Customer support and dispute resolution
6Payment & Commission Terms
- Basic Plan: 18% commission
- Professional Plan: 15% commission
- Enterprise Plan: 12% commission
Payment Processing: All payments are processed securely through Karat Dollar, our integrated payment partner. We use PCI-DSS compliant infrastructure and never store full credit card information.
Payment Methods: Credit/debit cards, instant EFT, mobile money, and other methods as displayed at checkout.
Security Deposits: Equipment owners may require security deposits (maximum 3x daily rental rate). Deposits are fully refundable within 48 hours after equipment return, subject to inspection.
Payout Schedule: Equipment owners receive payment within 48 hours of rental completion, after deducting platform commission.
8Insurance & Liability
Renter Liability: Renters are responsible for equipment during the rental period. Any damage beyond normal wear and tear may result in repair charges or loss of security deposit.
Owner Liability: Owners must ensure equipment is in good working condition, safe to use, and meets all applicable safety standards.
Platform Liability: SmartQuip acts as a marketplace facilitator. We are not liable for equipment condition, safety, performance, or disputes between owners and renters, except as required by law.
